The Legal Department is a structural unit of Lesya Ukrainka Volyn National University (hereinafter referred to as the University) and reports directly to the rector of the University. The legal department of the University is established and functions in accordance with the General Regulation on the legal service of the ministry, other central executive body, state enterprise, institution and organization, approved by the Cabinet of Ministers of Ukraine Resolution No. 104 of November 26, 2008.
The legal department of the University is guided in its activities by the Constitution and laws of Ukraine, decrees of the President of Ukraine and resolutions of the Verkhovna Rada of Ukraine adopted in accordance with the Constitution and laws of Ukraine, acts of the Cabinet of Ministers of Ukraine, international treaties of Ukraine, these Regulations, the Statute of the University, the Rules of Internal Procedure of the University, the Collective contract, as well as other normative legal acts.
The main tasks of the legal department are the organization of legal work aimed at the correct application, strict compliance and prevention of non-compliance with the requirements of legislation, other regulatory acts of the University, by their manager and employees during the performance of tasks and functional duties assigned to them, as well as representing the interests of the University in courts
The legal department, in accordance with the tasks assigned to it:
1) ensures the correct application of normative legal acts and other documents at the University, submits proposals to the rector regarding the resolution of legal issues related to the activities of the University;
2) develops and participates in the development of draft acts and other documents related to the activities of the University;
3) conducts a legal examination of draft acts and other documents prepared by structural divisions of the University, approves (endorses) them in the presence of visas of heads of interested structural divisions or persons replacing them. In case of non-compliance of the draft of the act or other document with the requirements of the legislation, submits to the interested structural unit motivated proposals to bring it into compliance with the legislation;
4) conducts, together with the University's structural subdivisions, revision work in accordance with its competence of acts and other documents with the aim of bringing them into compliance with legislation;
5) informs the rector of the University about the need to take measures to amend acts and other documents, recognize them as having lost their validity, or cancel them;
6) organizes work related to: conclusion and registration of contracts with legal entities and individuals regarding persons studying at the University; conclusion of labor agreements and contracts with University employees; preparation of draft orders and orders of the University administration. The legal department participates in the preparation and monitoring of implementation, provides a legal assessment of the drafts of the above-mentioned documents. The listed documents are approved (endorsed) by the legal department in the presence of visas of the heads of the interested structural units or persons replacing them;
7) participates in ensuring the protection of property rights and legal interests of the University in case of non-fulfillment or improper fulfillment of contractual obligations;
8) organizes claim and lawsuit work, analyzes its results;
9) supervises compliance by structural subdivisions with the procedure for presenting and considering claims established at the University;
10) promotes the timely adoption of measures to eliminate violations specified in the documents of the prosecutor's response, court decisions, relevant documents of law enforcement and control bodies;
11) submits to the rector of the University: proposals for improving the legal support of the University's activities; conclusions regarding the legality of write-off of material assets, receivables, unproductive expenses and legal assessment of the facts of shortages, thefts, mismanagement, damage to property;
12) considers materials on compensation for material damage at the expense of guilty persons, which are prepared by relevant structural divisions based on the economic and legal analysis of accounting data and statistical reporting, other documents of financial and economic activity of the University and materials of inspections conducted by law enforcement and control bodies;
13) promotes the observance of legality in the exercise of the rights of the University's labor team during the resolution of industrial and social issues;
14) together with the interested structural divisions of the University, participates in the preparation of measures to strengthen labor discipline and ensure labor protection at the University;
15) provides legal assistance to University employees who need social protection;
16) ensures the correct application of labor, housing, pension and other legislation relating to the rights and legitimate interests of University employees, submits proposals to the rector of the University regarding the restoration of violated rights;
17) organizes and carries out work aimed at increasing the level of legal knowledge of University employees, explains the practice of applying legislation, provides consultations on legal issues;
18) provides legal assistance in the process of creation, development and implementation of scientific and technical developments, the latest technologies, as well as in the implementation of measures to improve the performance of works, provision of services;
19) conducts official inspections regarding the observance of labor discipline by the employees of the University, on which he prepares a corresponding conclusion;
20) provides legal support for the lease of immovable property jointly owned by territorial communities of villages, towns, cities of the region and state property.
